Terms and Conditions (T&C) of CleanerPro

1. Scope

These Terms and Conditions apply to all orders placed via this website. The offer is intended exclusively for consumers residing in Switzerland.

A consumer is a natural person who enters into a business relationship with CleanerPro for purposes that cannot predominantly be attributed to a commercial or self-employed professional activity. Orders in quantities not customary for household use may be rejected without stating reasons.

CleanerPro reserves the right to amend these Terms and Conditions at any time. The version valid at the time of the order shall apply. For orders already confirmed, the Terms and Conditions accepted at the time of the order shall remain applicable. Deviating terms of the customer shall not be recognised.

2. Information on this website

CleanerPro provides information on products, prices and availability on this website. Changes to prices, assortment and technical specifications remain reserved.

Product descriptions, images, dimensions, weights, technical information and other details serve to describe the offer. They do not constitute a guarantee of specific properties unless expressly stated otherwise.

CleanerPro makes every effort to provide all information correctly, completely and up to date. Errors, typographical mistakes and obvious mistakes remain reserved. All offers on this website are non-binding and do not constitute a binding offer.

CleanerPro cannot guarantee that all listed products are available at the time of the order. Information on delivery times and availability is non-binding unless expressly stated as binding.

3. Prices

The sales prices stated are final prices in Swiss francs (CHF). Any statutory charges are included where applicable.

Any shipping costs or other additional costs are shown separately and must be paid by the customer if they are displayed and selected or confirmed during the ordering process.

CleanerPro reserves the right to make price changes, technical changes and corrections of errors or misprints. The price displayed in the shopping cart at the time of the order shall be decisive.

4. Conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.

By submitting the order, the customer makes a binding offer to conclude a purchase contract and accepts these Terms and Conditions.

CleanerPro automatically confirms receipt of the order by e-mail. This confirmation of receipt does not yet constitute acceptance of the offer.

The contract is concluded as soon as CleanerPro expressly accepts the order, confirms dispatch or delivers the ordered goods.

Orders are generally processed after full receipt of payment unless another payment method has been agreed. If the ordered goods are not available or only partially available, CleanerPro may reject the order in whole or in part. Payments already made will be refunded accordingly.

5. Payment methods and retention of title

The payment methods displayed during the ordering process are available to the customer.

CleanerPro reserves the right to exclude individual payment methods without stating reasons or to require advance payment.

In the event of late payment, CleanerPro may charge default interest of 5% per year and reasonable reminder fees of up to CHF 20 per reminder.

The delivered goods remain the property of CleanerPro until full payment has been received.

6. Delivery, inspection and notice of defects

Deliveries are made by post, courier service or another suitable shipping provider to the delivery address specified in the order.

CleanerPro endeavours to keep delivery times as short as possible. Delivery times stated are non-binding unless expressly confirmed as binding. Partial deliveries are permitted insofar as they are reasonable for the customer.

If delivery cannot be made or if the customer refuses acceptance, CleanerPro may withdraw from the contract after notification by e-mail and after setting a reasonable grace period, and may charge any additional costs incurred.

The customer is obliged to inspect the delivered goods upon receipt and to report any visible defects immediately by e-mail or letter. The contact details can be found in the legal notice.

Returns due to defects must be made after prior contact with CleanerPro. The goods must be returned complete, properly packaged and together with a description of the defect.

If the inspection shows that there is no defect or that CleanerPro is not responsible for the defect, CleanerPro may charge the customer for the costs incurred for inspection, return shipment or disposal.

7. Voluntary right of return

Swiss law generally does not provide for a statutory right of withdrawal for online purchases. However, CleanerPro voluntarily grants customers a contractual right of return of 7 calendar days from receipt of the goods, subject to the following conditions.

To exercise the right of return, CleanerPro must be clearly informed of the return by e-mail or letter within the specified period. The contact address can be found in the legal notice. No reason needs to be given. Sending the notification in time is sufficient to meet the deadline.

After exercising the right of return, the goods must be returned within 7 calendar days unused, complete, undamaged and, where available, in the original packaging together with the delivery note to the return address specified by CleanerPro.

The customer bears the costs and risk of the return shipment. CleanerPro will refund any payments already made within 20 calendar days as soon as the returned goods have been received or proof of shipment has been provided.

If goods are used, damaged, soiled, incomplete or not properly packaged, CleanerPro may claim reasonable compensation for the loss in value and offset this amount against the refund or invoice it separately.

There is no right of return in particular in the following cases:

  • for goods that are returned used, damaged, soiled or incomplete;
  • for goods that are not suitable for return for health protection or hygiene reasons if the packaging or seal has been opened after delivery;
  • for goods made to customer specifications or clearly tailored to personal needs;
  • for goods that are not suitable for return due to their nature or that may spoil quickly;
  • for digital content, downloads or services, if offered in the shop and already fully performed or provided.

Claims relating to defective or incorrectly delivered goods remain unaffected by this voluntary right of return.

8. Warranty for defects

CleanerPro endeavours to deliver goods of flawless quality. In the case of defects reported in due time, CleanerPro provides warranty for defects that already existed at the time the benefits and risks passed to the customer, within the scope of statutory warranty provisions.

CleanerPro may provide warranty, at its own discretion, by repair, replacement delivery, price reduction or refund of the purchase price. Further claims are excluded to the extent permitted by law.

Normal wear and tear, improper handling, damage caused by the customer or third parties, and defects resulting from external influences are excluded from warranty. No warranty applies to consumables and wear parts insofar as the defect is due to normal consumption or intended use.

9. Liability

CleanerPro is liable for direct damages caused by intentional or grossly negligent breach of contract. Any further liability for indirect damages, consequential damages, loss of profit or purely financial losses is excluded to the extent permitted by law.

Mandatory statutory liability, in particular in cases of unlawful intent or gross negligence, remains reserved.

CleanerPro assumes no liability for the content of external websites referred to by links. The operators of the linked pages are solely responsible for their content.

CleanerPro uses images, videos and other media to the best of its knowledge and in compliance with the relevant usage rights. Should third-party rights nevertheless be affected, CleanerPro asks to be notified accordingly so that the matter can be reviewed and corrected if necessary.

10. Data protection

CleanerPro processes personal data for the processing of orders, for the fulfilment of contractual and legal obligations and, where permitted, for customer communication.

Data necessary for the fulfilment of the contract may be passed on to commissioned service providers, in particular shipping, payment and IT service providers.

11. Severability

If individual provisions of these Terms and Conditions are or become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

12. Further provisions

CleanerPro reserves the right to amend these Terms and Conditions at any time. Amendments apply to future orders from the time of publication on the website.

Substantive Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory statutory places of jurisdiction remain reserved.

For claims brought by consumers, the statutory places of jurisdiction apply. Claims brought by CleanerPro against consumers shall be filed at the domicile of the defendant.
